The Sarbanes-Oxley Act of 2002 (SOX) was enacted to bring back public trust in markets. Building trust requires ethics within organizations. Through codes of ethics, organizations are put in line to conduct themselves in a manner that promotes public trust. Through defining a code of ethics, organizations can follow, market becomes fair for investors to have confidence in the integrity of the disclosures and financial reports given to them. The code of ethics include â€Å"the promotion of honest and ethical conduct, requiring disclosure on the codes that apply to senior financial officers, and including provisions to encourage whistle blowing† (A Business Ethics Perspective on Sarbanes Oxley and the Organizational Sentencing Guidelines). The Sarbanes-Oxley Act was signed into law from public demand for a reform. Even though there are some criticism about it, the act still stands to prevent and punish corporate fraud and malpractice. The Sarbanes-Oxley Act was security law that was birthed from corporate and accounting scandals. The act’s name was drafted from Senator Paul Sarbanes and Congressman Michael G. Oxley. Oxley is a congressman who introduced his Corporate and Auditing Accountability and Responsibility Act to the House of Representatives. Understanding Philippine poverty II-CURRENT ISSUES Understanding Philippine poverty By BERNARDO VILLEGAS MANILA, Philippines – There have literally been dozens of studies on Philippine poverty over the last decade or so, by economists in Philippine universities, the World Bank, the Asian Development Bank and other international agencies. The latest one is entitled â€Å"Examining recent trends in poverty, inequality, and vulnerability† written by Dr. Jose Ramon Albert and Mr. Andre Philippe Ramos of the Philippine Institute for Development Studies (PIDS) which has produced over the years some very useful policy-oriented studies that can guide decision making in both the government and the private sector. The conclusion of the study is not a very happy one. As based on statistics released by the National Statistical Coordination Board (NSCB) for 2000, 2003, and 2006, poverty in the Philippines is seen not to have substantially changed since the start of the millennium. Although there was a reduction of the proportion of the population who were considered poor from 33. 6 percent in 2000 to 30 percent in 2003, the poverty rate in 2006 increased to practically where it was at the beginning of the millennium at 32. 9 percent. Poverty has remained mostly unchanged and has also continued to be a predominantly rural phenomenon, with three out of every four persons found in the rural areas. The outlook looks even bleaker if the Philippine economy continues to grow at the same pace as it did in the last decade or so. It will take more than 17 years for half of the poor to exit poverty even if the per capita incomes of all persons in the country were to increase uniformly by 2 percent annually (adjusted for inflation). It will take an average time of 40 years for the poor to exit poverty if annual growth per capita is at 1 percent. It is quite evident from these projections that the Philippine economy must grow at 7 percent or more annually for the next ten or more years for there to be a significant reduction in poverty. A 7 percent growth in GDP would mean about 5 percent annual growth in per capita income since population growth is a little under 2 percent per annum. The experiences of the East Asian countries over the last twenty years (especially China) is that a growth of at least 7 percent in GDP annually for 20 years or more can make a significant dent on mass poverty. The Philippines has not attained this sustained growth of 7 percent or more over the last two decades mainly because of flawed economic policies based on import-substitution industrialization and an utter neglect of countryside and agricultural development. We can be optimistic that the 7 percent or more growth is attainable in the next decade or so because lessons have been learned from the past errors. Today, there is greater emphasis on export-oriented industrialization and more importantly, there is keener focus on rural and agricultural development. A greater portion of the capital budget of the Government is being spent on farm-to-market roads, irrigation systems, and post-harvest facilities. No longer is agriculture considered as the Cinderella of development. The study of Dr. Albert and Mr. Ramos also showed that in the rural areas, those at the lower and middle portions of the income distribution benefited less from growth during the period studied than those at the upper end of the distribution. They found out that while inequality went down as a whole for the country and urban areas for the period 2000 to 2006, the rural areas suffered from increased inequality largely brought about by differences in the top of the income distribution ladder. In view of these changes in income distribution, headcount poverty in the country decreased only by 0. 7 percent. Had there been no worsening of the inequality seen in the rural areas where the upper-income groups were the ones who benefited more from growth, headcount poverty would have fallen from 33. 6 percent to 22. 6 percent. The very modest gains in the fight against poverty can be attributed to improper targeting mechanisms for propoor projects and the absence of monitoring and evaluation systems for program implementation. The authors recommended that propoor public interventions that do not seem to have an impact should be reoriented, especially those with implementation and targeting issues. Policies and programs oriented toward the prevention of the transmission of poverty from one generation to the next, â€Å"especially by way of human resource investments and population management† must be essential components of any sustainable reduction strategy of poverty and vulnerability. The authors have something positive to say about the controversial program of the present Administration of conditional cash transfers to the poorest of the poor. With improved rural infrastructures such as farm-to-market roads, domestic seaports and airports, telecom facilities and educational institutions, this more efficient distribution of population will go a long way to reducing poverty in the rural areas. But if they mean reducing family sizes, the authors are contradicting themselves. They repeat over and over again that poverty is predominantly a rural phenomenon and is concentrated in the households of small farmers who are poor because they have been deprived by the State of the support infrastructures they need to earn decent incomes. They have to draw water from the rivers, plow their fields with the most primitive methods, bring their goods to the market using roads in the most horrible state of disrepair, etc. How can you tell these rural families to have only two children? As the Philippines has financially limited resources and a high poverty rate, the rapid increase in population has become a problem because there is already insufficient resources to support the population, which leaves much fewer resources to improve the economy. From 2003 to 2006, even though the Philippines experienced above-average economic growth, the poverty incidence actually increased as a result of its population growth rate. Unemployment Poverty reduction has not kept up with GDP growth rates, largely due to the high unemployment rate, high inflation rate and wide income inequality. From 2000 to 2009, the economy of Philippines grew by 3. 2% on average annually, which was on par with the economic performance of its neighbors. It has been in practice from as far back as the 1970s. However, at the time, educators that implemented the model had not identified a universal name for it. They were simply catering to the needs of their students. Therefore, the literature on the subject during this decade mostly focuses on the learning theories that support differentiated instruction. Some educational theorists wrote a lo t about the need for differentiated instruction. One such individual was Lev Vygotsky, who established the zone of proximal development theory (Logan, 2012). It was his work that formed some of the theoretical foundations of this teaching practice today. Vygotsky, in 1978, states that every learner has a zone of proximal development. At this level, the child will experience learning in a manner that is challenging but not too difficult for the child. An educator who meets the child at their zone of proximal development will promote teaching in the most effective way. They will provide instruction in a context that matches the readiness level of the child. Writers in the subsequent decade also examined the plausibility of differentiated instruction. Some looked at its effects while others counterbalanced this with a number of arguments. In 1987, Slavin highlighted the dangers of grouping students according to their ability. He studied analyses done in various schools and found that r egrouping of math students led to poorer achievement in schools that maintained the practice. The debate over differentiated teaching was just picking up momentum in the 1980s. During the 1990s, most literature on the subject revolved around proving that differentiated instruction can work. Sternberg and Grigorenko carried out a study to assess the impact of differentiated instruction in 1999. The investigators used students’ grade performance to determine whether this teaching model was effective. In order to sufficiently assess whether differentiated instruction had taken place, they looked at whether teachers attempted to match thinking styles with content. The two authors explained that a student could belong to one of three thinking styles. They could be practical thinkers who thrive in active-forms of delivery. Alternatively, creative thinkers require a different approach because they tend to look for hidden meanings. Thirdly, a student could be an analytical thinker wh o can find solutions in a seemingly complex set of variables. Matching instruction to these individuals’ thinking styles is what made the difference in their learning outcomes (Watts-Taffe et. a.l., 2012). I. Introduction Audio spotlight is a very recent technology that creates focused beams of sound similar to light beams. By ‘shining sound to one location, specific listeners can be targeted with sound without other nearby hearing it, i.e. to focus sound into a highly directional beam. The audio spotlight uses ultrasonic energy to create extremely narrow beam of sound that behave like beam of light. Audio spotlighting exploits the property of non-linearity of air. When inaudible ultrasound pulses are fired into the air, it spontaneously converts the inaudible ultrasound into audible sound tones. like audible sound ultrasound waves, get distorted as they travel through air. The ultrasound waves are breaked into lower frequency, i.e. audible sound waves. so these ultrasound waves can travel along a narrow path, people to left or right of a target remain silence. II. System Requirement A. Hardware Requirement: A transducer(speaker). An amplifier. Coax cable. III. Architecture The ultrasound has wavelengths only a few millimeters long, which are much smaller than the source, and consequently travel in an extremely narrow beam. Of course, the ultrasound, which contains frequencies far outside our range of hearing, is completely inaudible. But as the ultrasonic beam travels through the air, the inherent properties of the air cause the ultrasound to distort (change shape) in a predictable way. This distortion gives rise to frequency components in the audible band, which can be accurately predicted, and therefore precisely controlled. By generating the correct ultrasonic signal, we can create, within the air itself, essentially any sound desired. Note that the source of sound is not the physical device you see, but the invisible beam of ultrasound, which can be many meters long. This new sound source, while invisible, is very large compared to the audio wavelengths its generating. So the resulting audio is now extremely directional, just like a beam of light. Often incorrectly attributed to so-called Tartini tones, the technique of using high-frequency waves to generate low-frequency signals was in fact pioneered by physicists and mathematicians developing techniques for underwater sonar over forty years ago. IV. System Description The Audio Spotlighting Device consists of a round shaped disc which consists of a transducer, an amplifier and coax cables. Transducer is very discreet, at only 1/2† thick. Then, she turns her attention to the basic functions of international human resource management, among them recruitment and selection of new employees, development and training of employees, assessment of work efficiency, as well as remuneration of employees. As the expatriates are often given special attention by their work organizations, she concludes the paper with the description of the additional challanges occurring in the management of these employees. 1. INTRODUCTION In Slovenia, with a population of only two million, we have a lot of organizations doing business successfully, not only in the domestic but also in the international environment. Lek, one of our two pharmaceutical companies; Fructal, which produces juices from various kinds of fruit; SCT, the road construction company and Mura, which produces mens and womens clothes, are some examples of our most prominent firms. In those, as well as in similar organizations that function in the global environment, they can use different approaches to managing employees. How they find employees, pay, train, and promote them varies with culture. They usually attempt to treat their employees equitably, yet in a culturally appropriate manner. When the organization sends its employees to some other country, it takes over the responsibilities besides the basic functions of human resource management. For example, the functions of staffing, training and development are especially emphasized in this organization. They do not deal merely with the selection of the best employees for work in foreign countries but also have to be aware of the needs of the whole family that will accompany the employee to the new cultural environment. A lot of individuals taking on international assignments are unsuccessful since their spouces or families can not adjust to their new surroundings. Hence, it is necessary to organize training in the foreign language for the employee and his family some months before departure. Everything necessary for the journey, including visas, have to be provided for on time. It is also necessary to prepare their residence in the new surroundings, as well as to assure health services and enrolment into schools for the children of the employees. 2. APPROACHES TO MANAGING AND STAFFING SUBSIDIARIES Companies can apply one of the three different approaches to managing and staffing their subsidiaries (Francesco, Gold, 1998): 1.Ethnocentric. The home country practice prevails with this approach. Headquarters from the home country makes key decisions, employees from the home country hold important jobs, and the subsidiaries follow the home country resource management practice. 2.Polycentric. Each subsidiary manages on a local basis. A local employee heads a subsidiary because headquarters managers are not considered to have adequate local knowledge. Subsidiaries usually develop human resource management practices locally. 3.Geocentric or global. The company that applies the global integrated business strategy manages and staffs employees on a global basis. For example, Electrolux (the vacuum cleaner company) has for many years attempted to recruit and develop a group of international managers from diverse countries. These people constitute a mobile base of managers who are used in a variety of facilities as the need arises. In the ethnocentric approach, the cultural values and business practices of the home country are predominant. Headquarters develops a managing and staffing approach and consistently applies it throughout the world. Companies following the ethnocentric approach assume the home country approach is best and that employees from other parts of the world can and should follow it. Managers from headquarters develop practices and hold key positions in the subsidiaries to ensure consistency. He is described as placid and pious, industrious and poor (Kaye 74). In religious belief and practice he was a Quaker. He lived ten years in France, from 1792 to 1802, took part in the French Revolution and met thousands of Frenchmen, yet he never learned enough French to make a speech in that language, or to say anything at all except the few sentences that were needed in ordering food and commenting on the weather (Great Theosophists: Thomas Paine n.d.). In 1750, he was taken from school to be taught the trade of staymaking. It was a handicraft that required a fairly long apprenticeship. One had to learn the qualities of various fabrics, such as silk, linen and calico. Cutting the cloth was an operation that called for skill, for each pair of stays was an individual product. Tape measurements of the customer were made in the first place, and a pattern was laid out (Kaye 23). After nearly five years in his father's shop Tom Paine ran away. In 1756, he went away again and joined the privateer King of Prussia, commanded by a Captain Mendez. He was as reticent about it as about everything that concerned his personal life. On March 26, 1771, he married Elizabeth Ollive. He was then thirty-four and she was ten years younger (Kaye 24). During 1770s, Paine played an active role in the political life of England: he joined officers in Parliament and published his first political article The Case of the Officers of Excise. In 1774, Paine came to America and devoted himself to the revolutionary cause. The most important fact is that Paine was the first author who wrote for the whole American public. During the first six months after its publication about one hundred thousand copies of Common Sense were sold (Larkin 29). His religious ideas and vision of an ideal society Paine expressed in the Agee of Reason. This work consists of three parts appeared in 1794, 1795 and 1807. The first part of the book was written when he was in good health, and without the aid of a Bible; it was meant to shock men into thinking, but compared to the second part it is a model of restraint. It was dedicated to "my Fellow Citizens of the United States," though he was evidently dubious of their enthusiasm for it" (Paine 45). Paine never overlooks an opportunity to humble aristocratic arrogance. He called men to practice the moral virtues, and the belief of one God Larkin 29). Granted, stockholders, stakeholders, patients, etc. were negatively effected for a short duration, and there were presumably several more stockholders and so on effected by the recall than there were potential deaths, but a company such as Johnson and Johnson has been able to maintain its positive image and consumer loyalty due to behaviors which are viewed as being morally responsible, so the short-term effects were likely minimal and exactly that: short-term.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   An opposing argument might be that the risks of any human life actually being lost was minimal, and that a random product sampling would have been enough to determine if indeed any other product had been contaminated, and therefore the product should NOT have been recalled, simply because the potential risk of loss of human life and the lawsuits sure to follow was less than the risk of dollars lost by the company, by the shareholders, by employees, suppliers, distributors, etc.   Some might argue this loss is far greater than any of the potential risks associated with the poisoned pills. However, once again to cite the Utilitarian principle, whatever is morally â€Å"right† is that which creates the most happiness, or overall â€Å"good,† for the larger number of people.   Again, human death is something that is generally received as far more severe than the temporary loss of money (which can be recovered).   15 human deaths in comparison to a loss of 15 million, even billion, dollars is far more significant in the minds of most people in our society. Especially for a consumer product (and not for any greater purpose, such as the freedom of our country which leads to casualties of war), there is no level of acceptable loss of human life in the interest of saving a large corporation some money.   The perseverance of human life produces greater happiness with the public, which also reinstalls faith in a morally responsible company such as Johnson and Johnson, which allows them to fairly easily recover any net losses, which puts all the stockholders and others effected by it right back on a level playing field.   And no lives were lost.   By Utilitarian principles, everyone in this situation wins.

Therefore it is the duty of the human resource department to come up with a well structured way that can be used to look at the welfare of the workforce. (Finegan 2004, p. 71) A grievance handling produced clearly defines a process which is used by the organization to look at the complaints that has been given by the employees. It presents a process of initial resolving of the complaints through arbitration. It is a process that is used to indentify and resolve the companies in a timely manner in order to promoted the prevail a constructive discussion between the management and the representatives of the employees. therefore the aim of the grievance procedure is to ensure that there is a proper mechanism in place that is used by the management to look at the issues that pertains to employees in order to ensure that there is constructive resolving of the complains at they arises. Apparently tourism has emerged to be one of the most important industries in the world. It has been fueled by increased spending culture in the world and increased openness. Tourism has taken many dimensions in its growth in areas of cultural tourism, business tourism, leisure tourism, education tourism, medical tourism, and other areas. In all these segments, individual usually travels away from their homes to go to foreign countries. Therefore they need to be accommodated and given other services. In this regard the hospitality industry comes in hand as it offers them support in accommodation and other necessary services. The hospitality industry has therefore hinged its growth on the tourism sector. (Leornard 2001, p. 52) One of the emerging natures of the hospitality industry has been diversity that has been experienced in the customers that the industry target and also in the workforce. There has been an increasing trend in the industry towards culture convergence in which one hospitality facility in the world is serving people of diverse culture. Therefore there has been an aspect of standardization of culture in the industry. Cultural homogeneity is considered to be one of the competitive factors that need to achieve in order to survive in the competitive market. With the market become more diverse due to divers needs of the customers, the hotel industry have therefore tended to have a divers nature of employees in order to help their customers to feel at home every time they are being served. Therefore there has been an increasing trend of multicultural workforce in the industry. This of course has come with its own challenges to human resource management. One of the most challenges that faces any human resource management is a multicultural workforce is the way to handle complains by the employees. As a result the industry is force to keep on hiring and lying off some of the workers. It has continuously become difficult for the industry to hire more employees on permanent bases due to the fact that there are period when the industry will need more workers while the off seasons will need less workers. Therefore there is a factor of the way in which employees are hired and retained in the industry. This has been one of the most contentious issues especially when it come to the labor unions which have been arguing that there is need for the industry to hire employee on permanent bases. There are a times when the industry is forced to lay off the employee unexpected due to the prevailing circumstance. For example in Kenya which is one of the famed tourism destinations in Africa, the last year skirmishes had a negative effect in the industry. It is recorded that though it was the high season when the tourism and hospitality industry expected a great inflow of guest, more than 10,000 employees were laid off. This was due to massive cancellation of bookings that had been done. The industry has apparently hired more workers in anticipation for the high season that had just started to pick up. There has been a conflicting situation in the industry as the employee who had been hired on contracted bases want to be paid all the money as their contract had defend while the industry is trying to recover from a massive losses incurred due to the massive cancellation. This has been caused by the fact that the industry sometime will need to hire more employees and other times it will have to lay off some the employees. This is because every time an employee is dismissed from their duties for a genuine reason, they run to the court to place complains and what follows is an argument about the rights of het employees. Although the employer has the responsibility of recognize the rightist of the employee, there has been the question of the responsibility of the employee especially when it comes to the nature of the operation of the industry. Being in an industry that calls for meticulous performance of duties in order to ensure the satisfaction of the employee, there has been incidence where the employee have been dismissed on the ground of misbehaving with the guest or failing to perform their duties and what follows is a lawsuits for the company. (Mitchell, 2007) There has been increasing misinterpretation of the National Labor Relation Act when it comes to the employees working in the hospitality industry. There has been a need to becoming familiar with the law and its interpretations. There has been misinterpretation of the act when it comes to the employers also. It has been shown that there are many incidences when the employers back off from their earlier salary agreement and fire off employee who complains. But the law has shown the act is inclusive even of the employee who works in the hospitality industry who are likely to work for part time bases. Holiday Inn has been one of the most prosperous hotels that have become major player in the hospitality and tourism industry. It has been able to spread its wings all over the world and has grown to be a multinational in a very short period. It has positioned itself in all the corners of the world which have tourism potential and therefore it has a world wide presence. Like any other play in the industry, the hotel has been receiving a number of complains from the customers as well as from the workers themselves. Since the hotel has been relying on tourism activities in its overseas operation, the hotel has been experience same problems as we have mentioned above which are all hinged on the satisfaction of the employee and on other factors. But is has successfully put in place a mechanism that is used to handle all these complains. It has been dealing with a range of complains about its employees and at the same time there have been complains from the employees on the way they are beign treated. (Dilts 2006, p. 34) In order to handle all these complains, the hotel first steps which were aimed at streamlining it relationship with the employees was the formation of the human resource department which was supposed to look at the welfare of the employees. The human resource department was apparently responsible for looking at the welfare of the employee and also it was to handle complains from the employee. Therefore it was given the authority to deal with issue of hiring and firing of the employees. In areas where the hotel has been hiring seasonal workforce, it has been putting the employee on a contractual agreement where they are supposed to be paid according to there performance and not on the bases that eh were hired. This has been made in order to avoid many complains that come from the workforce once they are dismissed from their employee when the low seasons comes. The hotel has also made sure that it has put in place a board that is supposed to scrutinize all the complains that are received from the employees so that it can look into the way of making sure that they are well addressed. The board or the arbitration body is supposed to work in close conjunction with the human resource department to make sure that there is a well defined procedure that is followed while dealing with the complains. Therefore there have been systematic efforts by the hotel that has been aimed at reducing the level of complains with the workforce. These efforts have also been aimed at ensuring that all the employees are handled as equal and that complains are dealt with as a matter of urgency. From time to time there will be complains from the workforce. These complains are most of the time genuine and they indicates that there is a problem that need to be fixed somewhere in the work process. The human resource department that has been given the mandate of dealing with the issue of these conflicts understands that employees are the most important treasure that ht organization holds. It has to deal with the employee well, so that it will gain a competitive edge in the market. Therefore it is good for the management to come up with proper way of dealing with these complains in order to avert further action from the employee. Most of the time if these complain is not dealt with they are likely to precipitate to strikes which will have a negative effect on the productivity of the industry and also on the image of he industry. The tourism and hospitality industry has been one of the industries that have been suffering major grievances from employee due to issues of off and on season employment and low payment. There have been major labor action in the industry which has been caused by these complain that has been expressed by the workforce. Therefore there is need for the players in the industry to handle some of these complains well and take the example of Holiday Inn which has come with effective mechanisms that are meat to deal with the problem firmly.
